In Texas, the presumption is that both parents will have joint legal custody, sharing critical decisions about the child’s life, including where the child will reside. There are limited situations where the court can grant one parent sole legal custody (now known as “managing conservatorship”), but the preference of the courts is that both parents have meaningful involvement with and access to minor children.
