If you are a DACA recipient who received a three-year Employment Authorization Document (EAD after February 16, 2015, was mistakenly issued and must be returned. Immigration estimates that 2,100 DACA recipients were issued three-year instead of two-year EADs. On February 16, 2015 a court injunction Texas v. United States, No. B-14-254 (S.D. Tex.) was in place which barred Immigration from granted three years. Immigration has already taken action to correct this issue and is re-issuing corrected two-year EADs to these individuals. They are also sending a letter to these affected DACA recipients that the three-year EADs are no longer valid and must be returned immediately along with approval notices.
If a DACA recipient does not follow the instructions on the letter or does not return the EAD, their DACA will be denied and they will have to reapply again. Immigration has been going to the houses of these affected DACA recipients to pick up the cards.
Please note that not everyone is affected by this. There were approximately 108,000 DACA recipients who received a three-year EAD on or before February 16, 2015 who are not affected and they do not need to take any action.
