Is it possible for my ex-spouse to leave the state with my kids?

In Texas, the determining factor with respect to custody and visitation is the best interests of the child. Furthermore, family law judges in Texas prefer arrangements that give minor children access to both parents. In most custody orders, the court will impose limits on travel by either a custodial or a non-custodial parent, typically within the county or within counties adjoining the county of residence. A parent may take a child outside of that area only with the approval of the other parent, and often only with the approval of the court. Taking the children outside of that geographic area without permission can be the basis for a citation for contempt of court.
