Bailey & Galyen Partner Interviewed on Good Morning Texas
Bailey & Galyen attorney Ian Croall, a managing partner with 17 years at the firm, spoke recently with Paige McCoy Smith of Good Morning Texas, explaining the basic concepts related to social security disability benefits. Attorney Croall gave an overview of the program, discussed eligibility requirements, and talked about ways people can both expedite the process and increase the likelihood that a claim will be approved.
What Are Social Security Disability Benefits?
As attorney Croall explained, the social security disability insurance (SSDI) program is a federal program that provides financial assistance to individuals who cannot work because of injury or illness. The injury need not be work-related. SSDI benefits are generally available to people who cannot work for at least 12 months.
What Are the Eligibility Requirements for SSDI Benefits?
According to attorney Croall, to be eligible for social security disability payments, you must have earned at least $1,200 per month for a minimum of five of the last 10 years. Provided you meet that threshold, you must have an injury that is expected to either last for 12 months or more or result in your death. The injury or illness must prevent you from working in any capacity in the national economy.
The Importance of Having a Lawyer Guide You Through the Process
Croall stressed that, while you can handle an SSDI claim by yourself, you’ll be much better served by having an experienced attorney to assist you:
- Your attorney can work directly with SSA representatives to ensure that they have the medical documentation to support your claim.
- Your lawyer will also work with medical professionals to make certain that their reports accurately state the nature of your injury or illness.
- SSDI claims involve a substantial amount of paperwork. Your attorney will be familiar with the forms and can review them for accuracy and effectiveness.
Croall also emphasized the importance of filing a claim as early as possible. Approval can take up to 24 months. The longer you wait, the greater the risk of financial injury to you and your family.
Attorney Ian Croll is a graduate of Florida State University and the Dedman School of Law at Southern Methodist University. He has successfully advocated for SSDI claimants in all 50 states, as well as Puerto Rico. A native of Massachusetts, he now lives in Richardson with his wife and two children.
