Attorney Kern Lewis, Director of Catastrophic Litigation at Bailey & Galyen, spoke about the firm’s catastrophic injury practice recently with Paige McCoy Smith, of Good Morning Texas. Lewis spoke to Smith about what differentiates a “catastrophic” injury from other types of personal injury claims, explaining that it generally refers to an injury that will last a lifetime, such as a burn injury, spinal cord injury or traumatic brain injury. These types of injuries, Lewis explained, require that you plan for considerable future expenses for such things as medical care, income loss, loss of enjoyment of life, and loss of companionship.
Lewis stressed that catastrophic injuries can result from a wide range of accidents, including falls, motor vehicle accidents, and work-related accidents. He also spoke at length about the potential in Texas for “dram shop liability,” where the owner of a bar or restaurant serves alcohol to someone who becomes impaired and then causes a car accident. Lewis also noted that certain injuries may not seem serious initially but later develop into catastrophic claims, particularly injuries to the brain.
