When you are hurt on the job, you must show only two things to qualify for workers’ compensation—that you were injured and that the injury was work-related. Workers’ compensation is essentially a “no-fault” system, and does not require proof of negligence or fault. You cannot recover workers’ compensation for injuries that were not suffered on the job, and you cannot recover benefits for injuries that were intentionally inflicted. However, if your injuries were caused, in part or in whole, by your negligence, you still have the right to benefits, provided the injury was work-related.
